Rent-to-Own Agreement Template and How to Draft One (2026)
What is a rent-to-own agreement, and when do you need one? A rent-to-own agreement (also called lease-to-own or rent-to-buy) lets someone rent an asset now and buy it later, with part of the deal structured so the rent period leads towards ownership. It is used for homes, vehicles and equipment. In substance it is two agreements in one: a lease for the rental period, and an option (or an agreement to sell) that gives the tenant the right to buy at a set price within a set window. You need a written rent-to-own agreement whenever you want the renting and the future purchase to be governed by one clear set of terms, so that neither side can later dispute the price, the credits or the right to buy. It helps to keep the two halves separate in your mind. During the lease, the owner still owns the asset and the tenant pays rent. The option is a separate promise: if the tenant exercises it in time and meets the conditions, the sale goes ahead at the agreed price. Getting the boundary between these two right is what makes a rent-to-own agreement work. Below is a template you can copy and adapt, followed by guidance on how to fill each field. This is general information, not legal advice. For immovable property in particular, have the final document reviewed, because stamp duty and registration rules are strict. ## Rent-to-own agreement template ```

Frequently asked questions
- Is a rent-to-own agreement the same as a sale?
- No. During the lease the owner still owns the asset and the tenant pays rent. The sale only happens if the tenant exercises the option to buy within the agreed window and completes payment. For immovable property in India this matters a lot: an agreement to sell is not a transfer of ownership under the Transfer of Property Act, 1882, and the final sale needs its own deed, stamp duty and registration. This is not legal advice.
- What happens to the rent credits if I decide not to buy?
- That depends entirely on what the agreement says, which is why the rent-credit and option-lapse clauses are so important. A common structure is that rent credits and the option fee only count towards the price if the purchase completes, and are forfeited if the tenant does not exercise the option. Read those clauses closely before signing so you know exactly what you keep and what you lose.
- Does a rent-to-own agreement need to be registered in India?
- It can involve more than one registrable document. A lease over a certain term, an agreement to sell and the final sale deed may each attract stamp duty and require registration under the Registration Act, 1908, and the rules vary by state and by whether the asset is immovable property or goods. Treat each document separately and confirm the local position. This is general information, not legal advice.
